GAEL GARCÍA AND DIEGO LUNA AGAINST DIAGEO.
Mexico City.- The Supreme Court of Justice of the Nation determined that the company Diageo México will have to pay Gael García and Diego Luna for using their image without consent during the campaign "Walking with Giants", by Johnnie Walker, in 2011, even when the company did everything possible to avoid this payment.
The courts will determine the amount of the fine that those affected must pay. However, this is not the first case of fights between artists and brands, so here we share some of them.
GUILLERMO DEL TORO AND VICTORIA BEER
Guillermo del Toro got a big surprise when he saw that Cerveza Victoria used his image and that of some of his monsters in a special edition of its can, as part of the Halloween and Day of the Dead celebrations. When the filmmaker saw the news, he wrote on his social networks: "Very badly done, @VictoriaMX. These cans do not have my authorization, nor my consultation, or my signature to use my image or my name. Donate the proceeds to the multiple children's math or robotics teams. They need it."
After the issue went viral, the creator contacted Guillermo del Toro and they "rectified the misunderstanding" and decided to donate the proceeds to two projects, Special Olympics Mexico and MatemáticasCDMX."The cans with my signature and face They will be replaced by a new graphic project (at no profit to me) and on their side, part of the profits will be donated to @CDMXOMM and @SOMEXICO_Gracias."
ARIANA GRANDE AGAINST FOREVER 21
For using a model nearly identical to her, Forever 21 and beauty brand Riley Rose were sued for $10 million in 2019 for appropriating her image and using her music without her permission .
