Those affected by the anti-competition agreements carried out between dealers and car manufacturers between 2006 and 2013 can claim compensation that covers up to 10% of the price they paid for the vehicles purchased in that same period. The actions and fines of the National Commission of Markets and Competition (CNMC) against this so-called 'car cartel' have been endorsed and ratified by the Contentious-Administrative Chamber of the Supreme Court, after the National Court dismissed all the appeals that the brands had filed against the CNMC sanctions.
After the confirmation of the Supreme and that, previously, a Mercantile Court of Cádiz already agreed in April with a buyer who had acquired a vehicle in 2010 and who required financial compensation, the ban is opened so that almost 10 millions of affected people follow the same path.
Who can claim?
Any natural or legal person, individually or collectively, who has been affected by this exchange of "secret, future and strategic" information, as the CNMC described it. Among those affected are not only private drivers, but there are also car rental companies or companies with large fleets, taxis and VTC.
To find out if our car is one of the models affected by these actions, it is possible to use the tool made available to the public by the Association of People Affected by the Car Cartel (AACC) on its website. Simply access the page and insert the make and model of the car as well as the year of purchase. Automatically, it will be reflected if that car was bought for a higher price or not.
How can you claim?
The way to claim can be collective or individual, although it is true that through certain associations of affected people such as AACC it is easier to face the entire process. Before starting the entire legal procedure to request compensation, it is necessary to collect all the documents that justify and certify the purchase of a vehicle affected by the 'car cartel'.
The essential documents are the purchase invoice or proof of payment for the rental or leasing of a vehicle, the amounts paid for repairs (if any), in addition to the technical data sheet of the vehicle and the corresponding contracts.
